General Conditions of Contracting and Participation

1. Owner information

These General Conditions govern the contracting of and participation in the activities and services offered by:

2. Subject matter

These General Conditions govern access to, booking, contracting of and participation in all the services provided by VERSA STUDIO, SL, including: Cadillac Room, Duo Rooms, Reformer Studio, Versa Room (Barre, Yoga and Pilates Mat), Private Fitness Room (personal training), Events and special activities, Memberships, Passes and any other service offered by the centre.

The booking or contracting of any service implies full acceptance of this document.

3. Contracting of the services

Contracting may be formalised in person at the centre or through the digital booking and management platform used by VERSA STUDIO.

The user warrants that the data provided is truthful, accurate and up to date.

4. Memberships

Memberships are personal and non-transferable. Each type of membership will include the services, limitations, prices and particular conditions indicated at the time of contracting.

VERSA STUDIO reserves the right to modify its commercial arrangements, while maintaining the rights acquired by existing clients.

5. Automatic renewal

Recurring memberships will renew automatically at the expiry of each contracted period. Cancellation must be communicated in writing at least fifteen (15) calendar days before the next renewal date. Otherwise, the corresponding fee will be charged and the renewal will be deemed accepted.

6. Cancellations of membership

The cancellation of a membership does not give rise to any right to a refund of amounts already paid or of services not used, except in the cases legally provided for.

7. Temporary freezing of memberships

Membership holders may request a temporary suspension for justified reasons. The freezing:

  • Must be requested in writing.
  • Will require prior approval from the centre.
  • Will have a minimum duration of 15 days.
  • Will have a maximum duration of 3 consecutive months.

VERSA STUDIO may require supporting documentation.

8. Passes and vouchers

Passes are personal and non-transferable. The sessions included must be used within the validity period established. Sessions not used within the validity period will expire automatically without any right to a refund.

9. Bookings

All bookings will be made through the official channels provided by VERSA STUDIO. Places are subject to availability. VERSA STUDIO may change instructors, rooms or timetables when organisational needs so require.

10. Cancellations

Bookings may be cancelled without penalty up to twelve (12) hours before the start of the session. Cancellations made outside this period will result in the loss of the booked session.

11. No-show

Failure to attend without prior cancellation within the established period will result in the automatic loss of the session. In repeated cases, VERSA STUDIO may temporarily limit the client's ability to book in advance.

12. Waiting list

Places that become available will be allocated automatically according to the order of the waiting list. It is the client's responsibility to check the notifications received.

13. Declaration of health and physical fitness

The client declares that they are in a suitable condition to take part in physical activities. They undertake to report any relevant circumstance that may affect their participation, including injuries, pregnancy, medical procedures or physical limitations.

14. Informed consent for physical activity

The client declares that: they are aware of the nature of the activities carried out at the centre; they understand the risks inherent in the practice of physical activity; they participate voluntarily; they will follow the instructions of the instructors; and they will stop the activity at the first sign of any symptom that may compromise their health.

The services provided by VERSA STUDIO are for sporting and wellbeing purposes and do not constitute medical acts or healthcare treatments.

15. Exclusion of liability

The client participates at their own risk. VERSA STUDIO will not be liable for damages arising from: incomplete or incorrect information provided by the client; failure to comply with the instructions of the professionals; improper use of the facilities; or negligent conduct by the user themselves.

16. Rules of conduct

Users undertake to: respect the timetables; respect other clients and professionals; use the equipment correctly; and maintain conduct compatible with the environment of wellbeing and respect that characterises Versa.

17. Minors

The participation of minors will require the express authorisation of their legal representative. VERSA STUDIO may establish additional requirements depending on the activity.

18. Non-payment

Services may be suspended immediately in the event of non-payment. The costs arising from bank charge-backs may be passed on to the client.

19. Modification of services

VERSA STUDIO may modify timetables, instructors, rooms or activities where necessary to ensure the correct functioning of the centre. These modifications will not give rise to any right to compensation.

20. Force majeure

VERSA STUDIO will not be liable for failures to comply arising from circumstances beyond its control, including health emergencies, administrative restrictions, interruptions to supplies or other situations of force majeure.

21. Personal belongings

Clients are responsible for their personal belongings. VERSA STUDIO will not be liable for losses, thefts or damage, except in the cases legally required.

22. Facilities and equipment

Users undertake to use the equipment appropriately and in accordance with the instructions of the professionals. Damage caused by negligence may be claimed from the person responsible.

23. Right of admission and continued access

VERSA STUDIO reserves the right of admission and continued access. Access may be suspended for persons who engage in conduct incompatible with the values of the centre or who put at risk the safety and wellbeing of third parties.

24. Video surveillance

For security reasons, the facilities may have video surveillance systems in common areas. No cameras will be installed in changing rooms, toilets or spaces intended to preserve the privacy of users. The images will be processed in accordance with the regulations in force on the protection of personal data.

25. Data protection

Personal data will be processed in accordance with the Privacy Policy published on the VERSA STUDIO website.

26. Authorisation for the use of image

Authorisation for the capture and use of images will be voluntary and will be obtained by means of specific and separate consent. Refusal to authorise it will not affect the contracting of the services.

27. Modification of the conditions

VERSA STUDIO reserves the right to modify these General Conditions in order to adapt them to regulatory, technical or organisational changes.

28. Partial invalidity

The invalidity of any of the provisions will not affect the validity of the rest of the document.

29. Applicable law and jurisdiction

This document is governed by the legislation in force in the Principality of Andorra. Any dispute arising from its interpretation or application will be submitted to the competent courts of the Principality of Andorra.
