By using this Website, the Applications (where applicable) and/or by communicating electronically with VERSA STUDIO, S.L. through its website: www.versa.ad, the personal data requested from the User are collected and processed. The data provided by the User will be included in an automated personal data file owned by VERSA STUDIO, S.L., which will be processed in order to provide the information or services requested by the User. The user authorises the automated processing of the personal data provided, which are necessary for the provision of the agreed services, and which is governed by this privacy policy.

The personal information collected from registered clients is stored in a database owned by VERSA STUDIO, S.L., which adopts the technical, organisational and security measures that guarantee the confidentiality and integrity of the information in accordance with Qualified Law LQPD 29/2021, of 28 October, on the protection of personal data, Decree RLQPD 391/2022, of 28 September, and the Regulation on the Protection of Personal Data GDPR EU 2016/679.

VERSA STUDIO, S.L., through its website, will use the data provided by the User internally to inform the User of products and services that may be of interest to them.

VERSA STUDIO, S.L., will not disclose these data to third parties, except where strictly necessary to manage the service provided and/or maintain the relationship with VERSA STUDIO, S.L., or with your specific prior authorisation.

In any case, your data will be processed with a level of protection in accordance with the applicable Data Protection rules and will not be subject to automated decisions.

The controller of the personal data that the User provides when accessing and using the Website and the Applications is VERSA STUDIO, S.L., whose registered office for these purposes is at: Av. de les Nacions Unides, 41, 1r. Local 9 –AD700- ESCALDES-ENGORDANY (PRINCIPAT D’ANDORRA).

The legal basis for the processing is the legitimate interest of VERSA STUDIO, S.L. in maintaining the existing relationship with the User and, where applicable, their consent. Accordingly, VERSA STUDIO, S.L. will collect and keep your data while the relationship remains in force and, where applicable, until the User withdraws the consent given to the processing of their data. In any case, when the personal data are no longer necessary for the purpose for which they were collected, and until they are definitively deleted, they will be kept blocked.

Any registered user may at any time exercise the right to access, rectify and, where applicable, erase the personal data provided on the website www.versa.ad, as well as the other rights provided for in the legislation.

The user undertakes to notify any change or modification to the personal data they have provided. Any loss or damage caused to the Website or to agents, to VERSA STUDIO, S.L. or to any third party through the communication of erroneous, inaccurate or incomplete information shall be the sole and exclusive responsibility of the User.

What data we process

Depending on your relationship with VERSA STUDIO, S.L., we may process the following categories of data:

• Identification and contact data: first name, surnames, telephone, email address and any other data you provide to us.
• Booking and service data: classes or sessions booked, attendance, passes or packs purchased and information needed to manage your relationship with VERSA.
• Financial and billing data: information needed to manage payments, issue invoices and comply with accounting and tax obligations.
• Health data: information you provide to us through the health form, the Check-up or other communications, where necessary to assess whether the physical activity is suitable, adapt how it is practised or provide the service safely.

We will only ask you for the data that are adequate and necessary for each purpose. Please do not include health information in the general contact form unless it is necessary to deal with your enquiry.

3. What we use the data for and on what legal basis

When we rely on legitimate interest to respond to an enquiry, that interest consists of being able to manage the communications we receive in order to reply to them.

4. Health data and confidentiality

Some activities of VERSA STUDIO, S.L. may require us to know certain information about your state of health, physical limitations or other circumstances relevant to exercising. In such cases, we will inform you of the data we need, the specific purpose of the processing and whether providing them is necessary for us to be able to provide the requested activity safely.

Health data will be processed with the appropriate level of confidentiality, with access limited to the staff of VERSA STUDIO, S.L. who need to know them to perform their duties and provide the service entrusted, as well as to service providers who must process them on our behalf, always subject to the corresponding data protection obligations. Any disclosure of your data will always be based on your explicit consent.

You may withdraw this explicit consent at any time by contacting our DPO – Berta Faura. You can do so by sending an email to her address: dpd@versa.ad or in writing for her attention at the registered office of VERSA STUDIO, S.L. set out in the Legal Notice. Withdrawal will not affect the lawfulness of processing carried out previously, but it may prevent us from continuing to provide a specific activity where the data are necessary to do so safely.

5. How long we keep the data

We will keep enquiry data for as long as necessary to answer them and follow them up. Data relating to clients, bookings and services will be kept while the relationship with VERSA STUDIO, S.L. remains in force and, thereafter, for the periods necessary to comply with legal obligations or deal with potential liabilities.

Billing and accounting data will be kept for the periods required by the applicable legislation.

Health data will be kept only for as long as necessary for the purpose for which they were collected and, where applicable, for the periods necessary to deal with potential liabilities, in which case they will be kept blocked.

Data used to send commercial communications will always be processed on the basis of the consent given; if you withdraw it or ask to stop receiving them, we will unsubscribe you so that you receive no more, without prejudice to keeping the minimum information necessary to evidence and respect that decision.

6. Who we share the data with

Where necessary for the purposes indicated, we may provide the data to the following categories of recipients:

• Providers of the booking and client management platform.
• Providers of IT, hosting and communication services.
• Financial institutions and payment service providers.
• Advisers and providers of administrative, accounting or professional services.
• Public authorities and other bodies, where there is a legal obligation.

Providers that process data on behalf of VERSA STUDIO, S.L. have been duly selected to guarantee compliance with data protection legislation at all times and must at all times act in accordance with our instructions and with the applicable contractual and security safeguards.

7. International transfers

If any of these services involves an international transfer of data, we inform you that it will take place within the EU area, and we will also inform you of the corresponding recipients.

8. Mandatory and optional data

The data marked as mandatory in the forms are necessary to deal with the request or provide the corresponding service. If you do not provide them, we may not be able to manage the enquiry, formalise the contract or provide the requested activity.

The data requested solely for sending commercial communications are optional. Where health data are requested, we will tell you which are necessary to assess or safely provide a specific activity.

9. Your rights

You may at any time exercise your rights over your personal data: request access to them, their rectification or erasure or the restriction of processing, object to the processing or exercise the right to data portability where applicable. You may also withdraw any consent you have given at any time, without affecting the lawfulness of prior processing.

If you consider that the processing of your data infringes the legislation, you may lodge a complaint with the Andorran Data Protection Agency (APDA).

Intellectual and industrial property rights

The intellectual and industrial property rights in all texts, images and graphics, as well as in the source code, design, means and forms of presentation of its pages, belong, in their own right or as assignee, to VERSA STUDIO, S.L. Accordingly, the user acknowledges that the reproduction, repetition, distribution, dissemination, marketing, transformation and, in general, any other form of exploitation, by any means, of all or part of the content of this website constitutes an infringement of the intellectual and/or industrial property rights of the owner of the website or of the owner of such rights.
